The agreement behind every order.

These Terms of Service govern your access to and use of the Fairgold website and the purchase of any products through it. By using the site or placing an order, you agree to these terms. If you do not agree, please do not use the site.

1. Eligibility

You must be at least eighteen years old and legally able to form a binding contract to place an order. Orders ship only within the United States. By placing an order you represent that the information you provide is accurate and that you are authorized to use the payment method you supply.

2. Your account

You are responsible for keeping your account credentials confidential and for any activity that takes place under your account. Notify us promptly if you believe your account has been accessed without your permission. We may suspend or terminate accounts that appear to be compromised, fraudulent, or in violation of these terms.

3. Products, descriptions, and images

We describe each piece as accurately as we can, but small variations are normal in jewelry manufacture. In particular:

• Metal weights are approximate. The actual weight of a finished piece may vary slightly from the listed weight because of sizing, finishing, and ordinary manufacturing tolerances.
• Metal purity is represented at the stated karat and conforms to the tolerances set by the Federal Trade Commission's Jewelry Guides.
• Where a piece includes gemstones, any listed carat weights, dimensions, and grades are approximate and are described in line with FTC Jewelry Guides. Natural color variation and inclusions are characteristic of real stones.
• Product photos are representative. Actual appearance may vary because of lighting, screen calibration, sizing, and normal variation in finishing. Scale can differ from photographs.

4. Pricing, the live gold price, and checkout

Our prices move with the spot price of gold and update regularly. The price you see in your cart is locked the moment you successfully place your order. Subsequent movements in the spot price do not change the price of your completed order in either direction.

We try to keep prices and product information accurate, but errors happen. If we discover a material pricing or description error after you place an order, we may cancel the order and refund you in full rather than fulfill at the incorrect terms. We will notify you before doing so.

5. Orders and payment

Submitting an order is an offer to buy. We accept your offer when we successfully capture payment and confirm the order. Until then, no contract of sale exists and either party may cancel without penalty. We reserve the right to refuse or cancel any order at our discretion, including for suspected fraud, inventory issues, pricing errors, or shipping restrictions. If we cancel an order after capturing payment, we will issue a full refund.

Payments are processed by Stripe. By providing payment details at checkout, you authorize the charge of the order total, including any applicable sales tax and shipping, to the payment method you supply.

6. Shipping and delivery

Shipping terms, timelines, and costs are described in our Shipping Policy, which is incorporated into these terms. Risk of loss and title for purchased items pass to you upon delivery to the address you provided at checkout.

7. Returns

All sales are final. We do not accept returns or exchanges for change of mind, sizing, or preference. Our treatment of damaged, defective, and incorrectly shipped items is described in our Returns Policy, which is incorporated into these terms.

8. Not investment advice

Information on this site about the historical performance of gold is provided for general educational purposes only and is not financial, investment, tax, or legal advice. Past performance does not guarantee future results. Gold prices can fall as well as rise, and a piece of gold jewelry always carries a fabrication premium above the underlying metal. You should consult your own advisors before making any financial decision.

9. Warranty disclaimer

Except where prohibited by law, the site and the products sold through it are provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranty arising out of course of dealing or trade usage. We do not warrant that the site will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, Fairgold and its officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the site or any product purchased through it. Our aggregate liability for any claim arising out of your purchase is limited to the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow the limitation of certain damages, and in those jurisdictions our liability is limited to the smallest extent permitted by law.

11. Intellectual property

The Fairgold name, logo, site design, text, imagery, and other content are owned by Fairgold or our licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-transferable license to view the site for the purpose of considering and making a purchase. You may not copy, scrape, reproduce, or use our content for commercial purposes without our written consent.

12. Acceptable use

You agree not to use the site in any way that violates applicable law; to attempt to gain unauthorized access to our systems, other accounts, or any data we hold; to interfere with the operation or security of the site; or to scrape, crawl, or harvest data from the site by automated means without our written consent.

13. Indemnification

You agree to defend and indemnify Fairgold against any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your breach of these terms, your misuse of the site, or your violation of any law or of the rights of a third party.

14. Governing law and disputes

These terms are governed by the laws of the State in which Fairgold is organized, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these terms or your use of the site will be resolved in the state or federal courts located in that State, and you consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from seeking small-claims relief in a court of competent jurisdiction.

15. Changes to these terms

We may update these terms from time to time. The date at the top reflects when they were last revised. Continued use of the site after we post updated terms constitutes your acceptance of the revised terms. If the changes are material, we will make reasonable efforts to notify you.

16. Severability and entire agreement

If any provision of these terms is held unenforceable, the remaining provisions remain in full force and effect. These terms, together with our Privacy Policy, Shipping Policy, and Returns Policy, constitute the entire agreement between you and Fairgold regarding your use of the site.
